The age of consent in Italy is 14.

The claim is sometimes made that “In the Vatican State, there is an equal age of consent set at 12 years of age”, but this is incorrect. In 1929, when the Lateran Treaty was signed, the age of consent in Italy was 12, and this was indeed adopted by the Vatican. However, as stated above, the rise in the Italian age of consent applied automatically to the Vatican City.

The age of consent rises to 16 if one of the participants has some kind of influence on the other (e.g. teacher, tutor, adoptive parent). Not knowing the fact that the victim is underage is not a legal defence. It is also illegal to perform sexual acts in the presence of a minor with the intent of allowing the minor to witness the acts, even if they do not take an active part.
